Welcome to GigBig ("GigBig", "we", "our", or "us"). These Terms & Conditions ("Terms") govern your access to and use of gig-big.com, including all related services, applications, dashboards, communication tools, and content (collectively, the "Platform"). By accessing or using GigBig, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. About GigBig

GigBig is operated by:

  • Legal Entity: Gigbig Global LLP
  • Registered Country: India

GigBig is a managed services marketplace where clients can book individual services or managed teams, freelancers deliver services, and GigBig assigns a Project Manager to oversee execution, communication, and quality. GigBig is not an employer of freelancers unless explicitly stated.

2. Eligibility

You must:

  • Be at least 18 years old
  • Have legal capacity to enter into a contract
  • Provide accurate and complete information

By using GigBig, you confirm you meet these requirements.

3. Accounts & Registration

3.1 Account Responsibility

You are responsible for maintaining account confidentiality, all activities under your account, and providing accurate and up-to-date information. GigBig is not liable for losses caused by unauthorized account use.

3.2 Freelancer Verification

Freelancers must submit identity details, portfolio, and required documents, pass GigBig's review and skill assessment, and complete onboarding before receiving projects. GigBig reserves the right to approve, reject, suspend, or terminate freelancer accounts at its discretion.

4. Services & Project Flow

4.1 Client Options

Clients may book a single service or purchase a managed team package. In both cases, GigBig assigns a Project Manager, work is delivered through the GigBig dashboard, and communication happens via platform tools.

4.2 Project Manager Role

The Project Manager coordinates freelancers, oversees timelines and quality, and facilitates communication. They do not replace client decision-making authority.

5. Payments, Fees & Escrow

5.1 Payments

Clients must pay in advance. Payments are held in escrow and funds are released upon milestone or project completion. GigBig uses third-party payment providers (e.g., PayPal, Stripe).

5.2 Platform Fees

GigBig charges service and management fees, which may include platform usage, project management, quality assurance, and payment processing. Fees are displayed before checkout.

5.3 Freelancer Payouts

Freelancers are paid after project approval. Payouts depend on verification and payment provider processing times. GigBig may withhold payments for disputes or violations.

6. Refunds & Cancellations

6.1 Refund Eligibility

Refunds may be issued if work has not started, project is canceled early, or services materially fail to meet agreed scope. Refund decisions are final and discretionary.

6.2 Non-Refundable Items

Completed work, approved milestones, and platform or management fees (unless stated) are non-refundable.

7. Communication & Conduct

Users must communicate respectfully, avoid harassment, abuse, or discrimination, and use the platform for lawful purposes only. GigBig may monitor communications only for compliance, dispute resolution, or safety.

8. Intellectual Property (IP)

8.1 Client Ownership

Upon full payment, clients receive ownership of final deliverables unless otherwise agreed.

8.2 Freelancer Rights

Freelancers retain ownership of pre-existing work and portfolio rights (unless restricted).

8.3 Platform IP

All platform content, software, branding, and systems are owned by GigBig.

9. Confidentiality

All parties agree to keep project details, files, communications, and business information confidential unless legally required to disclose.

10. Prohibited Activities

You may not bypass the platform for payments or communication, use GigBig for illegal activities, upload malicious content, misrepresent identity or qualifications, or attempt to copy or exploit GigBig systems. Violations may result in suspension or termination.

11. Disputes & Resolution

11.1 Internal Resolution

GigBig encourages resolution through Project Manager mediation and internal review.

11.2 Final Authority

GigBig's decision in disputes is final.

12. Limitation of Liability

To the maximum extent permitted by law, GigBig is not liable for indirect or consequential damages, loss of profits or data, freelancer or client actions, or third-party service failures. Total liability shall not exceed the amount paid to GigBig for the relevant service.

13. Indemnification

You agree to indemnify and hold harmless GigBig from claims arising from your use, violations of these Terms, intellectual property infringement, or legal disputes caused by your actions.

14. Termination

GigBig may suspend or terminate accounts, restrict access, or withhold payments (if necessary) for violations, legal risks, or platform abuse.

15. Taxes & Compliance

Users are responsible for their own taxes, compliance with local laws, and reporting income. GigBig may deduct taxes where legally required.

16. International Use

GigBig operates globally. Users are responsible for complying with local laws.

17. Changes to Terms

GigBig may update these Terms at any time. Continued use indicates acceptance of updated Terms.

18. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Courts located in India shall have exclusive jurisdiction.
