Terms of Service

1. Introduction

Welcome to GigBig (the "Platform"). These Terms of Service ("Terms") govern your use of the platform, whether as a Client, Freelancer, or Team Member. By creating an account or using GigBig's services, you agree to these Terms.

2. Nature of the Platform

  • GigBig provides a marketplace + managed services: Clients can book single services or hire a full creative team via subscription.
  • GigBig facilitates contracting, communication, payment, and quality assurance, but is not a party to the service contract between Client and Freelancer.
  • Your contract for work is directly between you (Client) and the Freelancer (or Team), not GigBig.

3. Accounting, Eligibility & Your Account

  • You must register with accurate information and keep it up to date.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You may not share your account with anyone else.
  • If suspected fraudulent activity is detected, GigBig reserves the right to suspend or terminate your account.

4. Booking & Contracts

  • Single Service Bookings: You pay for one task, and GigBig assigns a PM + Freelancer.
  • Team Subscriptions: Recurring monthly plan; multiple tasks you submit go to your creative team.
  • GigBig will manage deliverables, revisions, and communication.
  • You may negotiate additional terms (NDA, copyright assignment, etc.) with your Freelancer, provided they don't conflict with these Terms.

5. Payments & Escrow

  • Payments are held in escrow (or similar mechanism) before work begins.
  • Funds will be released to the Freelancer (or Team) when agreed milestones are met, or final deliverables are approved.
  • GigBig may charge you a service fee (or platform fee) for using the Platform; these rates will be clearly disclosed at the time of booking.
  • GigBig may refund or cancel bookings under certain conditions (described in a separate refund policy).

6. Communication & Collaboration

  • Communication between Client, Project Manager, and Freelancer must happen inside the GigBig dashboard.
  • You may: chat, upload files, share comments, have audio/video calls, and screen-share.
  • GigBig is not liable for content you send via these communications, but we reserve the right to monitor or restrict communications for policy violations.

7. Ownership & Intellectual Property

  • Unless otherwise agreed, once payment is released, you (the Client) receive full ownership and usage rights for delivered designs.
  • Freelancers retain the right to showcase work in their portfolio unless a different NDA or confidentiality agreement exists.
  • You may request a custom IP agreement (copyright, trademark) in your project brief; GigBig can facilitate but not guarantee terms beyond standard license.

8. Revisions & Quality Guarantee

  • Clients can request revisions as specified in the project brief.
  • Project Managers oversee quality to ensure that deliverables meet your brief.
  • If you are not satisfied, GigBig may help reassign or rework content, subject to the revision limits or policies stated in your plan.

9. Dispute Resolution

  • If there is a disagreement about deliverables, payment, or scope, you should first seek resolution through your Project Manager.
  • In case of a failure to resolve, GigBig may provide a mediation or arbitration process.
  • You waive the right to file a class-action lawsuit; individual arbitration (or mediation) will be the exclusive remedy.

10. Prohibited Conduct

You may not use GigBig to:

  • Upload or solicit illegal content
  • Share private contact information outside the platform (until allowed)
  • Attempt to circumvent GigBig's payment system
  • Post or accept jobs that violate local or international law
  • Harass or abuse other users (Clients, Freelancers, PMs)

11. Termination & Suspension

  • GigBig may suspend or terminate your account for a breach of Terms, fraudulent behavior, or repeated policy violations.
  • You can terminate your Team Subscription at any time, subject to cancellation terms.
  • If you cancel, outstanding tasks will be handled according to the refund/billing policy.

12. Modification of Terms

  • GigBig may update these Terms from time to time.
  • Changes will be posted publicly, and, if required, you will be notified via email.
  • Continued use of the platform after changes constitutes acceptance of the new Terms.

13. Liability & Disclaimers

  • GigBig provides the platform, but does not guarantee the performance, professionalism, or results of any Freelancer.
  • GigBig's liability is limited to the amount you paid for the project or plan; we are not liable for indirect, special, or consequential damages.
  • We provide services "as is" — you agree that we cannot guarantee specific outcomes or profits from using GigBig.

14. Privacy & Data Security

  • We collect, store, and process your data in accordance with our Privacy Policy.
  • By using GigBig, you consent to our data practices, including storing files, messages, and project data.
  • We take reasonable security precautions, but no system is 100% secure; you acknowledge the risk.

15. Governing Law & Jurisdiction

  • These Terms are governed by [Your Country/State/Jurisdiction] law.
  • Any disputes will be resolved under [Your Country/State] law, via arbitration or court (depending on region).
  • If a provision is found invalid or unenforceable, it may be severed without affecting the remainder of the Terms.
